Who Pays For The City's Mistakes?

If this is all the city has they better be looking at ways to get more money into the general fund as Nuesse is going to clean their clocks. I at first thought the city had a case but after watching all this unfold I cannot believe we the tax payer are paying this judge $400 an hour to listen to the drivel the city is using as a case. If it wasn't for the judge getting paid by the hour he would have thrown this out long ago. We need to get rid of Kline and the city commissioners that allowed this to go on.

Whenever Kline and Co. opens the door for a lawsuit against the City - even if we want the defendant to prevail because we agree that he/she has been wronged by public servants - the tax payers end up paying for the settlement.

This is why I get angry about how they handled the Nuesse case. I don't know the ins and outs of the case. I only know the information that I have access to. This means that I don't know what it was like to work for Nuesse on a daily basis. Maybe Sams and Co. have a point when they say she was a bear to work for. Maybe she ignored them. Made them feel unappreciated (awww, sorry guys!) That's still no excuse for how they handled it. There's a way to get rid of nuisances - and this isn't the way to do it. You build a case against that person. You show a hardened and well established pattern. (If you can.) You make it full proof and you get the public behind you before you make a move.

They did none of this. They whined and acted like unprofessional weenies who didn't want to work for a woman.

And now we get to pay a settlement because of their behavior.

If you think I'm wrong, speak on it. I'm fair.

The City has to continue this trial because they need to allow her to have her due process. Whenever the government takes something from someone, like their job, the Constitution requires due process. If the City ended this trial without Nuesse having her full say, it would be grounds for a lawsuit and possible reinstatement.

The Police Chief is an "at will" employee. She can be fired for any reason, especially trust issues, as long as it is not an illegal reason. She has the City Manager and several (perhaps a majority?) of Commissioners saying they don't trust her. That is grounds for her termination. You may not like it, but that isn't really relevant.

Kline didn't have a majority, and Nuesse's lawsuit is about being fired for illegal reasons.

First there is no Nuesse lawsuit, this is a due process hearing, nothing more nothing less. Where is your evidence that she was fired for illegal reasons? She doesn't even seem to be talking about why she was fired, of course they are only into 200 of 700 questions about dispatch alone. She is simply trying to embarass the City into reinstating her or settling the matter. Costing the City $400+ an hour is her only leverage at this point. Otherwise she would wrap this thing up and get on to a real court.

Being at the hearings it is quite obvious she is trying to get her job back, which I hope she does and maybe we can finally get rid of crybaby Sams and the Girl Scout cookie monster Frost, and not trying to make money. If she did take this to court she knows, and now is quite evident to everyone, that she would win hands down. She would collect massive amounts of money and the city could not pay it. The amount she would get is far and away more then the insurance would cover. So it shows what she really wants is her job back and her name cleared. The city should do the right thing for the citizens and call a halt to this and give her job back. It is going to be far cheaper then letting this go to a court trial.

From what I am seeing, the city is in a lot of trouble with this case. The city's attorneys out flank Bailey three to his one. The questions the city attorneys come up with alone would be a concern as they seem off the wall kind of questioning. The city doesn't seem to produce too much evidence against Bailey's daily three brief cases full of evidence. This dispatch is a nightmare with too many hands into the pie and all of the entities fighting for their political power status and don't even bother to check if what they are doing is legal.

Westerhold was making the same prediction for McClung and his side kick. Millions of dollars he claimed were going to be paid out.

It is reasonable for Chief Meinzer to not want something as important as dispatch in the hands of such a questionable figure. That does not make him a crybaby but a responsible public servant.

I don't believe she has a shot at getting her job back or a settlement from the City of Sandusky. It is not that I am against her, I just don't think she has a case.

I think her only real shot at being vindicated is to run for Sheriff. When is Lyons up for re-election? Her attorney made an interesting observation about Sheriff Lyons not being disciplined for allegedly lying about dispatch. They don't seem to understand that there really isn't anyone but the voters to discipline the Sheriff.

Maybe that is her plan. Her case seems to be more about politics than employment. It would be an interesting match up!

To above: You are exactly right about it being about politics rather than employment. It is exactly why these entities will never come together for a regional dispatch and why she was fired in the first place because of the politics. Bailey is just warming up and about to kick it in high gear to the tune of 700 hundred plus questions coming up. The other side better hold onto their seats and come up with some good questions or they are going to get lost in the shuffle. The city's attorneys do not impress me and I can't wait until the feds testify.

One of the alleged reasons that she was fired was for dishonesty on the status of the dispatch system. This is probably the reason Nuesse's attorney has so many questions regarding dispatch. Like you said: it's due process. Nuesse has a right to get to the bottom of why she was fired and that's what her attorney is attempting to do.

Looks like there is indeed a lawsuit and that the city commission if not individual commissioners may be liable for being sued as well given that the entire city commission seems to be so inept in dealing with so many issues. How can we believe the city commission on anything if they are covering up the Nuesse debacle to protect their good ol boy club?


Where are all of those Nuesse haters now that the Federal Lawsuit has been filed? Can one even imagine where this is all headed?
